Leamington man jailed after breaching restraining order

A 42-year-old man from Leamington Spa has been jailed for two years after repeatedly breaching the terms of his restraining order.  

Mark Cleary was convicted of harassing his ex-partner and was subsequently given a restraining order in December 2022. The order forbade Cleary from contacting her or going to her house.  

Hopefully he will spend his time behind bars to reflect on his behaviour and consider changing his way

However, Clearly failed to comply with the order, violating it six times between June and October.  

Clearly contacted his ex-partner on social media and sat outside her house in his car. Then, on June 23, Clearly went to his ex-partner’s house and started kicking at her front door.  

The victim then came out to confront Clearly, resulting in him punching her in the face.  

After pleading guilty to six counts of harassment, Cleary was jailed at Warwick Crown Court for breaching his restraining order and with one count of assault. 

He was sentenced to two years and nine months in jail as of the week beginning 18 December 2023.  

PC Hollie Dewar from the Warwickshire Police Patrol Investigation Unit said in a statement: “Restraining orders are an extremely powerful tool to help us protect victims of domestic abuse and breaching them can carry severe consequences.” 

She then proceeded to say: “Clearly obviously had no respect for this restraining order, no respect for the courts and certainly has no respect for his ex-partner. Hopefully he will spend his time behind bars to reflect on his behaviour and consider changing his way.”
