Kasbah claim to receive Trump cease and desist

Kasbah nightclub are claiming to have received a cease and desist demand from The Trump Organization, shown in a status posted on the club’s Facebook page.

The correspondence comes after Kasbah used an image of Donald Trump on one of their recent Halloween promotional advertisements.

The letter, written by Alan Garten, Executive Vice President and General Counsel of The Trump Organization, outlines that Donald Trump is in fact the owner of the Trump image along with hundreds of additional trademarks that incorporate the Trump name and image which are protected by The Trump Organization.

The use of the image has been dubbed a “deliberate attempt to stimulate interest” in the club’s events without any authorisation for use from Donald Trump or his associates.

Apparently, unauthorised use of the image infringes common law and statutory trademark rights that the Trump image is protected by.

Alan Garten summarises that Donald Trump “considers this to be a very serious matter” and has authorised his legal team to take necessary and appropriate actions to bring “an immediate halt to your blatant and unauthorised use of his trademark image.”

Kasbah has been offered a one-time opportunity to rectify the matter by providing written assurances by Wednesday 26 October.

It is not truly known at this time whether or not the letter has been created as a joke or a publicity stunt, or whether it is actually genuine.
